Cricher AI Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cricher AI website, app, and related services (the "Cricher AI Platform"). By using the Cricher AI Platform you agree to these Terms.

1. Eligibility and Accounts

  • You must be at least 18 and have authority to bind any entity you represent.
  • You will provide accurate information and keep your account credentials secure.
  • You are responsible for all activity under your account.

2. Acceptable Use

  • Do not misrepresent your identity or submit false, misleading, or infringing content.
  • Do not harass, abuse, or interfere with other users or the Cricher AI Platform.
  • Do not attempt to bypass fees, security controls, or rate limits.
  • Use the Cricher AI Platform only as permitted by law and these Terms.

3. Creator Obligations

  • Provide authentic content and comply with applicable advertising and disclosure rules.
  • Deliver agreed work on time and in line with campaign requirements.
  • Maintain professional conduct with brands and other users.

4. Brand Obligations

  • Provide accurate campaign details, budgets, and timelines.
  • Pay creators as agreed and respect creative parameters.
  • Maintain professional conduct with creators and other users.

5. Fees and Payments

Fees, payment schedules, and any applicable platform charges are communicated within the Cricher AI Platform or in separate agreements. You are responsible for any applicable taxes.

6. Intellectual Property

  • You retain ownership of your content.
  • You grant Cricher AI a non-exclusive, worldwide, royalty-free license to host, use, reproduce, and display your content as needed to operate and promote the Cricher AI Platform.
  • You must have rights to any content you upload or submit.

7. Confidentiality

You will not disclose confidential information obtained through the Cricher AI Platform, including campaign details and non-public business information, except as required to perform agreed services or as permitted by law.

8. Third-Party Services

The Cricher AI Platform may link to or integrate with third-party services. Cricher AI is not responsible for those services, and your use is governed by their terms and policies.

9. Disclaimers

The Cricher AI Platform is provided "as is" and "as available." To the fullest extent permitted by law, Cricher AI disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free service.

10. Limitation of Liability

To the fullest extent permitted by law, Cricher AI will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenues, data, or goodwill. Cricher AI's aggregate liability arising out of or relating to the Cricher AI Platform will not exceed the greater of (a) the amounts paid or payable by you to Cricher AI in the three months before the claim, or (b) USD $100.

11. Indemnity

You will indemnify and hold harmless Cricher AI from claims, losses, and expenses (including reasonable attorneys' fees) arising out of your content, your use of the Cricher AI Platform, or your breach of these Terms.

12. Term and Termination

We may suspend or terminate access to the Cricher AI Platform at any time if we believe you have violated these Terms, applicable law, or risk harm to the Platform or users. You may stop using the Cricher AI Platform at any time. Sections that by their nature should survive termination will do so, including Intellectual Property, Confidentiality, Disclaimers, Limitation of Liability, and Indemnity.

13. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms with a new effective date. Continued use of the Cricher AI Platform after changes means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.
